BJSABER is an INDEPENDENT company. We are NOT affiliated with, sponsored by, endorsed by, licensed by, or approved by any of the following entities or any of their parent companies, subsidiaries, or affiliates:

• Star Wars (in any form)
• Any other media franchise, motion picture studio, television network, video game company, publishing house, or intellectual property owner

We do not claim, and have never claimed, any affiliation, sponsorship, endorsement, or licensing relationship with these entities.

We acknowledge and respect the intellectual property rights of others, including but not limited to:

Use of these terms on this page is purely for descriptive and nominative purposes (i.e., to identify the marks we are explicitly disclaiming any affiliation with), and constitutes nominative fair use under trademark law.

3. Originality of Our Products

3.1 Our Products Are Original Designs

All BJSABER products are original designs independently created by our team. We do not:

• ❌ Replicate, copy, or closely model any specific lightsaber design from any licensed motion picture, television show, video game, novel, comic book, or other media property
• ❌ Use any Lucasfilm / Disney / Star Wars character names, likenesses, or copyrighted designs in our products
• ❌ Use Lucasfilm / Disney / Star Wars trademarks (LIGHTSABER, STAR WARS, JEDI, SITH, etc.) in our product names, marketing, or branding
• ❌ License sound effects, music, or other copyrighted content from any third-party media property

3.2 What We Do

Our products are inspired by the general, public-domain concept of a handheld energy weapon / beam sword, which is:

• A longstanding trope in science fiction predating the introduction of any specific trademarked design
• A common visual archetype appearing in many works, including but not limited to: classic space opera literature, public-domain science fiction, independent games, original animation, and countless independent props and replicas
• Not unique to or owned by any single media franchise

3.3 Naming Conventions

We use original product names and category labels rather than terminology that would suggest affiliation with any licensed property. Our naming is generic (model numbers, descriptive terms like “beam sword” or “energy saber”) and does not reference specific characters, weapons, or designs from any third-party IP.

4. Fan Content and Community Creations

We welcome fan art, reviews, and community creations featuring our products. However, when creating content with our products:

• ❌ Do NOT create content that depicts our products in scenes, settings, or contexts that infringe third-party IP (e.g., placing our lightsaber in a scene depicting a copyrighted Star Wars location)
• ❌ Do NOT combine our branding with Lucasfilm / Disney / Star Wars trademarks in derivative merchandise (e.g., a T-shirt combining our logo with Star Wars imagery)
• ✅ DO feel free to make original reviews, tutorials, unboxing videos, and creative content featuring our products in original or generic contexts

We reserve the right to issue takedown notices for community content that combines our products with infringing third-party content.

5. DMCA Notice Procedure (Reporting Alleged Infringement)

If you are a copyright owner (or authorized to act on behalf of one) and believe that content on our Site infringes your copyright, you may submit a DMCA notice.

5.1 Required Elements (17 U.S.C. § 512(c)(3))

Your notice MUST include all of the following:

1. Your physical or electronic signature (or that of an authorized agent)
2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list)
3. Identification of the infringing material with enough detail for us to locate it (URL, product name, image filename)
4. Your contact information: physical address, telephone number, and email address
5. A good-faith statement: “I have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law”
6. An accuracy statement, made under penalty of perjury: “The information in this notification is accurate, and I am the [copyright owner / authorized to act on behalf of the copyright owner]”

5.3 Our Process

Upon receiving a valid DMCA notice:

1. We will acknowledge receipt within 3 business days
2. We will review the claim within 5-10 business days
3. If the claim appears valid, we will remove or disable access to the allegedly infringing material
4. We will notify the user who posted the content (if applicable) and provide them an opportunity to submit a counter-notice per 17 U.S.C. § 512(g)

5.4 Counter-Notice

If you believe content removed under a DMCA notice was the result of mistake or misidentification, you may submit a counter-notice including:

1. Your physical or electronic signature
2. Identification of the material removed and its prior location
3. A statement under penalty of perjury that you have a good-faith belief the material was removed in error
4. Your consent to the jurisdiction of the federal court in your district (or the district where the service provider is located) and your acceptance of service from the complaining party

If we receive a valid counter-notice, we may restore the removed material at our discretion, subject to the complaining party’s right to seek judicial relief.

6. Repeat Infringer Policy

We reserve the right to terminate the accounts of, and refuse service to, any user who is determined to be a repeat infringer of intellectual property rights.

7. Trademark Symbol Usage

Throughout our Site, you may see the ® and ™ symbols next to marks. These symbols indicate registered and unregistered trademarks of their respective owners. Their presence or absence does not affect the trademark status of any mark.
