1. Introduction and Acceptance

These Terms of Service (“Terms”) govern your access to and use of the BJSABER website located at bjsaber.com (the “Site”), including all content, functionality, and services offered on or through the Site.

BJSABER (“we,” “us,” or “our”) is a brand operated by Suzhou Yiyang Technology Co., Ltd., a Chinese limited liability company (有限责任公司) registered in Jiangsu Province, China, with its principal place of business at Room 602-01, Building W02, South Bank New Land, No. 11 Yangfu Road, Suzhou Industrial Park, Suzhou Area, China (Jiangsu) Pilot Free Trade Zone, China.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not access or use the Site.

2. Eligibility

To use the Site and make purchases, you must:

Be at least 18 years old (or the age of majority in your jurisdiction)
Have the legal capacity to enter into a binding contract
Not be prohibited from using the Site under applicable law

LIGHTSABER-SPECIFIC NOTE: While our lightsabers are collectibles and not weapons, they are electronic devices intended for users aged 13+ (per manufacturer safety guidance). EU/UK users under 16 require parental consent per GDPR Article 8 for information society services.

By using the Site, you represent that you meet these eligibility requirements.

3. Account Registration and Security

3.1 Account Creation

You may browse and purchase as a guest, or create an account. To create an account, you must provide accurate, current, and complete information.

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your password
All activities that occur under your account
Notifying us immediately of any unauthorized use

We will not be liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, including but not limited to:

Violation of these Terms
Fraudulent or illegal activity
Extended inactivity (24+ months)
At your request

4. Products, Pricing, and Availability

4.1 Product Descriptions

We strive to display accurate product descriptions, images, and prices. However, we do not warrant that product descriptions, images, or pricing are error-free, complete, or current.

4.2 Pricing

All prices are shown in the customer’s selected currency (USD, EUR, GBP, JPY, CAD, AUD)
Prices may change without notice
Prices shown do not include taxes, duties, or shipping unless explicitly stated
For US customers, sales tax is calculated at checkout based on destination
For EU/UK customers, prices include VAT where applicable

4.3 Availability

Products are subject to availability
We may limit quantities per person, household, or order
We may discontinue products at any time
“Add to cart” does not guarantee reservation — inventory is reserved only upon order confirmation and successful payment

4.4 Pre-Orders and Backorders

If you pre-order a product, you authorize us to charge your payment method at the time of pre-order (or shipment, as specified on the product page). Estimated delivery dates are approximate and not guaranteed.

5. Orders and Payment

5.1 Order Acceptance

Your order is an offer to buy, which we may accept or reject at our discretion. We accept your order when:

Payment is successfully processed
We send you an order confirmation email

We reserve the right to refuse or cancel any order, including but not limited to:

Suspected fraud or unauthorized payment
Pricing or product errors
Inability to verify shipping address
Legal restrictions (e.g., shipping to certain countries)

5.2 Payment Methods

We accept:

Visa, Mastercard, American Express, Discover, JCB, Diners Club
PayPal
Apple Pay, Google Pay (where supported)
PayPal (primary payment method), PayPal Pay in 4 (installments for qualifying US customers), Apple Pay (via PayPal, supported on compatible Apple devices)

Payment processing is handled by PayPal Holdings, Inc. We do not store your full card details on our servers.

5.3 Currency Conversion

For international orders, your bank or card issuer may charge additional foreign transaction fees, which are not controlled by us.

5.4 Sales Tax / VAT

US: Sales tax is calculated at checkout based on destination
EU/UK: VAT is included in displayed prices (where applicable)
Other regions: Import duties and taxes are the responsibility of the customer

By placing an order, you agree to the shipping terms set forth in the Shipping Policy, including:

Risk of loss passes to you upon delivery to the carrier
Title to goods passes upon full payment
You are responsible for any import duties in your country

8. PayPal Disputes and Chargebacks

8.1 PayPal Dispute Response Time

For transactions processed through PayPal, we commit to:

Responding to PayPal disputes and chargebacks within 20 days of notification
Providing all relevant documentation (order confirmation, shipping proof, delivery confirmation, customer communications) to support our position
Working in good faith to resolve disputes directly with customers before they escalate to formal PayPal claims
Maintaining transaction documentation for 7 years as required by financial regulations

If we fail to respond within 20 days, PayPal may automatically rule in favor of the buyer.

8.2 Other Chargebacks

If you file a chargeback with your bank or card issuer without first contacting us, we may dispute the chargeback with documented proof of delivery and your acceptance of these Terms. Fraudulent chargebacks may result in account suspension and referral to law enforcement.

9. Intellectual Property Rights and Trademark Notice

9.1 Our Intellectual Property

The Site and all content, features, and functionality (including but not limited to text, graphics, logos, images, product designs, the “PK” / faction system, faction names, code, and software) are owned by BJSABER or our licensors and are protected by US and international copyright, trademark, patent, and other intellectual property laws.

BJSABER trademarks and original works include:

BJSABER, BJ SABER (word marks and logos)
The PK (Power Knowledge) system design and mechanics
Our original faction names and visual identities
Product line names and SKUs (e.g., “XRGB”, specific lightsaber model numbers)
All original product designs, hilt shapes, sound profiles, and color schemes created by BJSABER
All marketing copy, photography, and videos created by BJSABER

9.2 Trademark Notice and Non-Affiliation Disclaimer

IMPORTANT — PLEASE READ CAREFULLY:

The term “LIGHTSABER” is a registered trademark and/or common-law trademark of Lucasfilm Ltd. LLC (a subsidiary of The Walt Disney Company) in the United States and many other jurisdictions.

BJSABER is an INDEPENDENT company. We are NOT:

❌ Affiliated with, sponsored by, endorsed by, or approved by Lucasfilm Ltd. LLC
❌ Affiliated with, sponsored by, endorsed by, or approved by The Walt Disney Company or any of its subsidiaries
❌ Authorized to use, and DO NOT use, any Lucasfilm, Disney, or Star Wars trademarks, service marks, trade dress, copyrighted character designs, or other protected intellectual property
❌ Replicating, copying, or closely modeling our products after any trademarked or copyrighted designs from licensed properties (including but not limited to: specific lightsaber designs from any motion picture, television show, video game, novel, comic book, or other media property)

Our products are inspired by the GENERAL science-fiction concept of a handheld energy weapon / beam sword, which is a common and longstanding trope in science fiction literature, film, and games that both predates and postdates the introduction of any specific trademarked lightsaber design. Any resemblance to specific fictional weapons depicted in popular media is generic and coincidental.

9.3 What This Means for You (Customer Acknowledgment)

By using the Site and purchasing our products, you acknowledge and agree that:

You understand BJSABER products are original designs not licensed by, endorsed by, or affiliated with any media franchise
You will not represent our products as licensed, official, or affiliated merchandise of any third-party intellectual property
You will not resell, redistribute, or commercially exploit our products in any manner that suggests or implies affiliation with any third-party intellectual property
You will not use our products, branding, or imagery in any content (including social media, videos, fan art, or livestreams) that infringes the intellectual property rights of others, including but not limited to Lucasfilm / Disney / Star Wars
You understand that certain jurisdictions may restrict or prohibit the import, possession, or display of products resembling weapons depicted in media, and you assume all responsibility for compliance with local laws

9.4 No Use of Protected Terms

We do NOT use the following protected terms in our products, branding, marketing, or metadata (except as required for descriptive or nominative fair use, and always with appropriate disclaimers):

“Lightsaber” or “light saber” (as a trademark — we use generic alternatives like “beam sword” or “energy saber”)
“Star Wars”
“Jedi”, “Jedi Knight”, “Jedi Master”, “Padawan”
“Sith”, “Sith Lord”, “Dark Lord”
“The Force”
“Midi-chlorian” / “Midichlorian”
“Darth [name]”
Specific character names (e.g., Luke, Vader, Yoda, Obi-Wan, Rey, Kylo Ren, etc.)
Specific weapon names (e.g., “lightsaber” as a generic descriptor is replaced with our own product names)

We may reference the general science-fiction genre for descriptive purposes (e.g., “inspired by science fiction”) but do not associate our products with any specific franchise.

9.5 Reporting Alleged Infringement (DMCA Notice)

If you believe that content on our Site infringes your copyright, please send a written notice to our designated DMCA agent that includes all elements required by 17 U.S.C. § 512(c)(3):

Your physical or electronic signature
Identification of the copyrighted work claimed to have been infringed
Identification of the material claimed to be infringing (with URL)
Your contact information (address, phone, email)
A statement of good-faith belief that use is not authorized
A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the owner’s behalf

We will respond to valid notices within a reasonable timeframe and take appropriate action at our discretion, which may include removing or disabling access to the allegedly infringement material.

Counter-Notice: If you believe content removed under a DMCA notice was the result of mistake or misidentification, you may submit a counter-notice per 17 U.S.C. § 512(g).

9.6 Repeat Infringer Policy

We reserve the right to terminate the accounts of users who are repeat infringers of intellectual property rights.

9.7 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes, subject to these Terms. This license does NOT include any right to:

Reproduce, distribute, modify, or create derivative works of our content for commercial purposes
Use our trademarks without prior written permission
Use our products, branding, or imagery in any manner that infringes third-party intellectual property

9.8 Feedback

If you submit feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use such feedback without restriction or compensation. Feedback will not include any confidential or proprietary information of yours.

10. User Conduct and Acceptable Use

You agree NOT to:

Violate any law, regulation, or third-party right
Use the Site for any fraudulent or illegal purpose
Impersonate any person or entity
Interfere with or disrupt the Site or its servers
Attempt to gain unauthorized access to any part of the Site
Upload viruses, malware, or other harmful code
Engage in spam, phishing, or unsolicited communications
Post content that is defamatory, obscene, hateful, or discriminatory
Harass, threaten, or harm other users
Circumvent any security or authentication measures
Use the Site to compete with us or for commercial surveillance

We reserve the right to investigate and take appropriate legal action against violations.

INTELLECTUAL PROPERTY COMPLIANCE: In addition to the above, you agree NOT to:

Use our products, branding, or imagery to create content that infringes third-party intellectual property (including but not limited to Lucasfilm / Disney / Star Wars trademarks, copyrighted designs, or trade dress)
Upload product photos or videos that place our products in scenes, settings, or contexts that infringe third-party IP
Use our products in connection with merchandise (T-shirts, posters, etc.) that combines our branding with protected third-party marks
Create derivative works (3D prints, custom mods, sound fonts) using our designs for commercial resale without permission

Violations of this section may result in immediate account termination, potential liability for infringement damages, and referral to the rights holder for enforcement action.

11. User-Generated Content (Reviews, Comments)

11.1 Your Content

You may post reviews, comments, photos, and other content (“User Content”) on the Site. You retain ownership of your User Content but grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, and distribute your User Content in any media.

11.2 Content Standards

Your User Content must:

Be accurate and based on your genuine experience
Not violate any law or third-party right
Not be defamatory, obscene, pornographic, or offensive
Not contain viruses or harmful code
Not be commercial solicitation or spam
Not impersonate any person

11.3 Monitoring and Removal

We may (but are not obligated to) monitor, edit, or remove User Content at our discretion, including content that violates these Terms.

12. Faction / PK System Rules (BJSABER-Specific)

BJSABER features an interactive “PK” system where users can contribute to faction energy pools (Light / Dark / Neutral Gray).

12.1 Eligibility

You must be logged in or provide a valid email to participate
Each user is limited to 5 contributions per day (per BJSABER PK energy system settings).
We use anti-fraud measures (IP tracking, rate limiting, CAPTCHAs)

12.2 Prohibited Behavior

You may NOT:

Use bots, scripts, or automated tools to manipulate faction energy
Create multiple accounts to inflate contributions
Sell or trade faction contributions
Attempt to game or exploit the PK system

Violations may result in:

Reversion of contributions
Account suspension or termination
Forfeiture of any associated rewards or perks

12.3 Faction Energy Has No Monetary Value

Faction energy contributions have no cash value and do not entitle you to any compensation, except as explicitly stated in promotional terms.

12.4 Discretion

We reserve the right to modify, pause, or discontinue the PK system at any time without notice.

13. Third-Party Links and Services

The Site may contain links to third-party websites or services (e.g., payment processors, social media, shipping carriers). We are not responsible for:

The content or accuracy of third-party sites
The practices of third-party services
Any damages arising from your use of third-party sites

Your use of third-party services is at your own risk and subject to their terms and privacy policies.

14. Disclaimers

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties that the Site will be uninterrupted, secure, or error-free
Warranties that defects will be corrected
Warranties that the Site or its servers are free of viruses or harmful components
Warranties regarding the accuracy, reliability, or completeness of content

PRODUCT-SPECIFIC DISCLAIMER: Our lightsabers are collectibles and display items. While we design them for safe use, we are not responsible for damage or injury resulting from:

Improper use, modification, or disassembly
Use by unsupervised children
Use as actual weapons
Failure to follow battery safety instructions (see product manual)

Some jurisdictions do not allow limitations on implied warranties; in such jurisdictions, the above limitations may not apply to you.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BJSABER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, use, goodwill, or other intangible losses
Any damages resulting from your access to or use of (or inability to access or use) the Site
Any damages resulting from any conduct or content of any third party on the Site
Any unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF:

The amount you paid to us in the 12 months preceding the claim, OR
$100 USD

Some jurisdictions do not allow limitations on liability; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless BJSABER and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

Your violation of these Terms
Your use of the Site, including User Content you submit
Your violation of any third-party right
Any claim that your User Content caused damage to a third party

17. Governing Law and Jurisdiction

These Terms and any dispute arising from or relating to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.

You agree to submit to the personal and exclusive jurisdiction of the People’s Courts of Suzhou City, Jiangsu Province, People’s Republic of China. Notwithstanding the foregoing, BJSABER reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

18. Dispute Resolution

18.1 Informal Resolution

Before filing a formal claim, you agree to contact us at legal@bjsaber.com and attempt to resolve the dispute informally for at least 30 days.

18.2 Arbitration

For any dispute that cannot be resolved informally, you agree that the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, except as otherwise provided.

You waive the right to participate in a class action lawsuit or class-wide arbitration.

18.3 Exceptions

Notwithstanding the above, either party may seek injunctive or equitable relief in court for:

Intellectual property infringement
Unauthorized access to the Site
Any claim that requires immediate relief

18.4 EU / UK Residents

If you are an EU or UK resident, you may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

19. Modifications to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the most recent change.

For material changes, we will:

Post a notice on the Site
Notify you by email (if you have an account)
For EU/UK users, request renewed consent where required

Continued use of the Site after changes constitutes acceptance of the updated Terms.

20. Termination

We may terminate or suspend your access to the Site at any time, with or without cause, with or without notice, including (without limitation) if we believe that you have violated these Terms.

Upon termination:

Your right to use the Site ceases immediately
We may delete your account and data (subject to our data retention policy)
Provisions that by their nature should survive termination shall survive (e.g., intellectual property, disclaimers, limitation of liability, indemnification, governing law)
